Rental Agreement, Waiver & Terms
Effective July 2026. By completing a booking with Matt's Kayaks, you (and every member of your group) agree to the following.
1. Assumption of risk
Paddling, floating, and all water activities are inherently dangerous. Risks include, without limitation: drowning; capsizing; collision with rocks, trees, dams, other vessels, or submerged objects; rapidly changing water levels, currents, and weather; cold-water immersion; wildlife; and remote locations where emergency response may be delayed. You voluntarily assume all risks, known and unknown, of participating in activities involving equipment rented from Matt's Kayaks.
2. Release and waiver of liability
To the fullest extent permitted by Virginia law, you release, waive, and discharge Matt's Kayaks, its owners, employees, and agents from any and all claims, liabilities, damages, or causes of action arising out of or related to your rental or use of equipment, including claims of ordinary negligence, whether occurring on or off the water, during shuttle transport, launching, or take-out. You agree to indemnify and hold harmless Matt's Kayaks against claims brought by you or members of your group.
3. Safety requirements
A U.S. Coast Guardāapproved personal flotation device (PFD) is provided with every rental and must be worn at all times on the water by every participant. You agree to: follow the route and hazard briefing given at launch (including staying clear of all dams and portaging where directed); not use equipment while impaired by alcohol or drugs; not exceed the boat's capacity; and stay off the water during thunderstorms or when directed by Matt's Kayaks. Renters must be 18+ to sign; minors participate only with a parent/guardian's signature and supervision.
4. River conditions & weather policy
Water levels and weather change quickly. Matt's Kayaks may cancel, delay, or relocate any trip for safety. If we cancel, you choose a full refund or a rebooking. If you cancel more than 48 hours before your trip, you receive a full refund; within 48 hours, we offer a one-time rebooking credit. No-shows are not refunded.
5. Equipment
You are responsible for rented equipment from delivery until pickup. Lost or negligently damaged equipment is charged at replacement cost (kayak/SUP up to $600, paddle $60, PFD $75, dry bag $30). Normal wear is on us.
6. Payments
Payments are processed by Stripe; Matt's Kayaks does not store your card details. Prices shown at checkout are final. Promo codes cannot be applied retroactively.
7. Photos
We occasionally photograph trips for our website and social media. Tell your shuttle driver if you'd prefer not to appear ā no hard feelings.
8. General
These terms are governed by the laws of the Commonwealth of Virginia; venue lies in the courts of the City of Lynchburg. If any provision is held unenforceable, the remainder stays in effect. Questions: float@mattskayaks.com Ā· (434) 555-0199.
